LONDON — The UK’s top-rated erectile dysfunction treatment, Viagra, has been suspended from shelves after a UK court ruled that its patent for the drug has expired, a move hailed as a step in the right direction.

Viagra, which is sold under the trade name Revatio, is the first erectile dysfunction drug to go generic, said the Guardian’s Daniel Watts, after it was revealed that the drugmaker had engaged in illegal marketing and sales of the drug to children.

The Medicines and Healthcare products Regulatory Agency (MHRA) said the suspension was “discriminatory and inaccurate” and had been based on a “pro-company” interpretation of the terms of the agreement. It said the suspension “is inconsistent with our agreement with Pfizer and with Pfizer’s business model”.

It said Pfizer’s strategy of “impartialing” the drug rather than approving it, and that it had not “discouraged” from doing so, adding that the company had “not taken the necessary measures” to avoid the potential risk of adverse effects.

The MHRA has been reviewing the legality of the agreement, and will be monitoring the transaction “in the interim.”

Viagra, the world’s top-selling erectile dysfunction drug, has been available worldwide since 1998 and is the world’s leading prescription drug, with over 1.2 billion prescriptions written in the U. S. last year.

Pfizer, which makes Viagra, said the suspension was “discriminatory and inaccurate” and had been based on a “pro-company” interpretation of the terms of the agreement.

The MHRA had previously reviewed the details of the agreement and recommended that Pfizer not take the action. However, the company was also reviewing its compliance with the agreement, which requires Pfizer to provide information on all Pfizer medicines that it sells, including Revatio.
